This document establishes the General Terms and Conditions of Use for the BeatPro digital platform, with its virtual headquarters at the domains BeatPro.app.

1. Objective

BeatPro is a technological solution focused on the commerce and distribution of musical content, such as instrumentals (beats), drum kits, and sound packs. In addition, the platform offers complementary services related to music production and marketing, such as content protection, subscription to exclusive features, creation and organization of personalized catalogs, and tools that assist producers in managing their music business. This Agreement governs the use of the platform by all users, whether they are producers (beatmakers), buyers, partners, or active commercial sellers.

2. Acceptance of Terms

By accessing or using BeatPro’s services, the user fully agrees to the conditions established in this Agreement and in our Privacy Policy. If the user does not agree with any clause herein, they must immediately cease using the platform.

BeatPro may change these Terms at any time, whenever necessary for legal adjustments, operational improvements, or the inclusion of new services. Any modification will be communicated with reasonable advance notice through the registered contact channels and/or with a prominent notice on the platform. Continued use of the platform after the update will imply tacit agreement with the new terms.

3. Registration and Access

Access to the platform requires the creation of a personal account, and registration is only permitted for individuals over 18 years of age or legally emancipated. By registering, the user declares to be fully capable of exercising the acts of civil life.

The user agrees to provide only true, complete, and up-to-date information, and is held civilly and criminally liable for any false data entered. Maintaining more than one active account on the platform, as well as assigning, transferring, or renting accounts to third parties, is expressly prohibited.

After registering, the user will receive a personal and non-transferable login and password. All activity performed with these credentials will be the sole responsibility of the user. In case of unauthorized or suspicious use of the account, the user must immediately notify BeatPro through support.

BeatPro reserves the right to suspend indefinitely or delete accounts that violate these Terms or exhibit fraudulent, offensive, or inconsistent behavior with the purpose of the platform.

4. Platform Usage

BeatPro provides its services 24 hours a day, seven days a week. However, it may temporarily suspend access to the platform or parts thereof for maintenance, updates, or operational reasons.

The user agrees to use the platform in an ethical, lawful, and respectful manner, refraining from any practice that violates the rights of third parties, legal norms, or the principles of digital coexistence.

It is not permitted to use the platform for illegal purposes, distribute offensive content, reverse engineer the systems, manipulate or interfere with the platform’s functionalities, or compromise the experience of other users.

5. Responsibility for Content and Copyright

All content posted by users, especially products for sale made available by producers, is the sole responsibility of their creators. By posting content, the user declares that they hold the copyright and related rights to said content, exempting BeatPro from any liability for violations, disputes, or damages arising from the misuse of third-party works.

Reproduction, distribution, adaptation, or any form of unauthorized use of the platform’s content and elements is prohibited, except with the express authorization of BeatPro or the rights holder. Violation of these terms may result in civil and criminal penalties under applicable law.

6. Products, Prices and Transactions

The products available on the platform are offered directly by the registered producers. Prices are set independently, respecting the minimum prices established by BeatPro: MP3 Free, Standard MP3 Lease, Premium WAV Lease, Exclusive WAV/MP3, and Exclusive Stens.

BeatPro may retain up to 30% of the transaction value as a brokerage commission, in addition to the fees required for payment processing.

After purchase, the products will be available for download on the platform for up to 6 months. After this period, BeatPro is not responsible for keeping the files available; it is the user’s responsibility to download them during the validity period. However, it is possible for the buyer, even after the 6-month period, to obtain access to the purchased product by directly requesting it from the producer or seller responsible. In these cases, BeatPro is not committed to providing the files, limiting itself, when possible, to providing the available contact information for the producer responsible for the transaction.

7. Content Distribution and Protection

Producers who choose the distribution and protection services offered by BeatPro will have their works broadcast on streaming platforms and social networks through a partnership with the distributor SoundON https://www.soundon.global/

The protection service uses the Content ID system, which allows for the identification and reclaiming of unauthorized copies of content on YouTube. Distribution covers platforms such as Spotify, Deezer, Instagram, Facebook, TikTok, and others, but only for Exclusive files.

Any and all use of phonograms or samples from third parties must be authorized exclusively by the producer, who assumes full responsibility for their work.

The distribution service may be interrupted at any time, without prior notice, due to termination or change in the commercial partnership with the distributor SoundON https://www.soundon.global/.

Furthermore, distribution is subject to specific rules, including: (i) a minimum holding period of 36 months for distributed tracks and (ii) a penalty for early takedown requests in the fixed amount of US$9.00 per track.

8. Subscription Services

BeatPro offers subscription plans that grant access to exclusive features and business tools. The price, frequency, and specific conditions of each plan will be transparently available on the platform at the time of purchase.

Subscriptions are automatically renewed unless canceled by the user before the renewal date. Fees paid are non-refundable, except in cases of proven failure to deliver the services.

BeatPro reserves the right to modify prices, terms and features of the plans, provided that it informs users in advance of any changes.

9. Payments

Payments may beperformed by default on Stripe/Paypal by Credit Card, users from Brazil viaPayment via Pix through MercadoPago and BinancePay globally, or according to the options available on the platform at the time of purchase.

10. Privacy and Data Protection Policy

BeatPro processes the personal data of its users in accordance with Law No. 13.709/2018 (LGPD), the Brazilian Civil Rights Framework for the Internet and, where applicable, the European GDPR at https://dreamsbeat.com/gdpr.

Data such as name, email, payment information, browsing history, consumption behavior, and preferences are collected. This information is used for contract execution, experience personalization, security, communication, and platform performance analysis.

With the implementation of the CRM tool, BeatPro will be able to share contact data with active sellers on the platform for direct marketing purposes, communication of promotions, offers, and sales support, based on legitimate interest. The user may object to this type of use at any time by contacting support.

BeatPro adopts technical and organizational measures to protect user data, including encryption, firewalls, access control, and backups. Any security incidents that may pose a risk to the rights of data subjects will be duly reported to the authorities and the affected user.

11. Exchange, Refund and Cancellation Policy

BeatPro maintains a clear policy regarding exchanges, refunds, and cancellations, in accordance with article 49 of the Consumer Protection Code (CDC), applicable to digital goods purchased electronically.

Because this is a platform that mediates digital products, such as beats, drum kits, sound packs, and service subscriptions, physical returns are not possible. However, the user may request a refund or exchange in cases of technical error, malfunction, proven security vulnerability, or delivery of a product that differs from the description.

There is no right to a refund in situations such as buyer’s remorse after downloading the content, unmet subjective expectations, purchase error, change of mind, or lack of technical knowledge on the part of the buyer. Platform subscriptions are non-refundable, but the user may cancel the renewal at any time, maintaining access until the end of the current cycle.

In disputes between buyer and producer, BeatPro acts as a mediator, based on a technical analysis of the situation presented. The platform’s decision is final, except in cases of court order.

13. Sanctions and Account Cancellation

BeatPro reserves the right to suspend indefinitely or cancel the account of any user who:

  • Disregard the terms established here;
  • Engage in illegal or fraudulent acts;
  • Do not use the platform in an abusive or harmful way to third parties;
  • Violate copyright or image rights.

14. Changes to these Terms

These Terms of Use may be updated or modified at any time. In case of significant changes, users will be notified in advance by email or a prominent notice on the website.

Continued use of the platform after such changes will be considered acceptance of the new terms.

15. Jurisdiction and Applicable Law

These Terms are governed by the laws of the Federative Republic of Brazil. The courts of the city of São Paulo/SP are hereby chosen as the competent courts to resolve any disputes arising from the use of the platform, with express waiver of any other jurisdiction, however privileged it may be.
